Terms of Service

Last updated: October 27, 2026

These Terms of Service ("Terms") govern your access to and use of the WebTwizz website, platform, and services (collectively, the "Services") provided by WebTwizz Technologies Inc. ("WebTwizz," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Acceptance of Terms

By creating an account, accessing, or using our Services, you confirm that:

  • You are at least 18 years old (or the age of majority in your jurisdiction)
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using our Services under applicable law
  • If you are using the Services on behalf of an organization, you have authority to bind that organization to these Terms

These Terms incorporate our Privacy Policy, which describes how we collect and use your information.

Our Services

WebTwizz is an AI-powered platform that enables users to create websites and web applications by describing what they want to build. Our Services include:

  • AI-powered website and web application generation
  • Visual editing and customization tools
  • Hosting and deployment of generated websites
  • Integration with third-party services
  • Templates and pre-built components

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of Services.

Account Registration

Creating an Account

To use certain features of our Services, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

One Account Per Person

Each person may only maintain one free account. Creating multiple accounts to abuse promotions, circumvent restrictions, or evade enforcement actions is prohibited and may result in termination of all associated accounts.

User Content

Your Content

"User Content" means any content you submit, upload, or input into our Services, including prompts, descriptions, text, images, code, and other materials.

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely to provide and improve our Services.

Your Responsibilities

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to use and share your User Content
  • Your User Content does not infringe any third party's intellectual property or other rights
  • Your User Content complies with all applicable laws and these Terms
  • Your User Content does not contain malware, viruses, or harmful code

Content Removal

We may remove or disable access to User Content that violates these Terms or applicable law, without prior notice. We are not obligated to monitor User Content but may do so at our discretion.

AI-Generated Content

Ownership

Subject to your compliance with these Terms, you own the websites, applications, and code generated through your use of our AI features ("Generated Content"). You may use Generated Content for personal or commercial purposes.

No Guarantees

AI-generated content is provided "as is." We do not guarantee that Generated Content will be:

  • Accurate, complete, or error-free
  • Suitable for any particular purpose
  • Free of bugs, security vulnerabilities, or defects
  • Unique or non-infringing of third-party rights

Your Responsibility

You are solely responsible for:

  • Reviewing and testing Generated Content before use
  • Ensuring Generated Content meets your requirements
  • Any use of Generated Content in production environments
  • Compliance with applicable laws when using Generated Content
  • Any damages or liabilities arising from your use of Generated Content

Similar Outputs

Due to the nature of AI, other users may receive similar or identical Generated Content when using similar prompts. We do not guarantee exclusivity of Generated Content.

Using WebTwizz from ChatGPT and Other AI Assistants

When you connect WebTwizz to ChatGPT or another AI assistant, these Terms apply to everything done in your WebTwizz account through it, the same as if you did it in WebTwizz yourself. Your use of the assistant is also governed by its provider's own terms.

  • You are responsible for the requests the assistant makes on your behalf. Review important changes, and only approve actions you intend, such as publishing a site
  • Work done through an assistant uses your WebTwizz credits and plan the same way as work done in the builder
  • We are not responsible for what the assistant itself says or does outside WebTwizz
  • You can disconnect an assistant at any time in WebTwizz under Settings, Sessions, Connected apps

Desktop App

These Terms apply to everything you do in WebTwizz through our desktop app (the "Desktop App"). This section adds terms for the Desktop App itself. Where it conflicts with the rest of these Terms on a matter about the Desktop App, this section controls.

License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Desktop App on computers you own or control, only to use our Services. You may not copy, modify, distribute, sell, or rent the Desktop App, or reverse engineer it except where the law allows. The license ends when your account ends or when you stop using the Desktop App, and you should then uninstall it.

Updates

The Desktop App checks for updates and may download and install them automatically. Some updates may be needed to keep using our Services. You can also check for updates yourself from the app's menu or settings.

Signing In

You sign in to the Desktop App through your web browser. The browser hands the app a one-time code that signs you in on that computer, and the code works only once and for a short time.

What Stays on Your Computer

The Desktop App keeps a few things on your computer so it works between launches:

  • Its settings, such as which notifications you get, opening at login, and appearance
  • A short list of your recent projects for its menus
  • Your signed-in session and cached pages, like a web browser keeps

Your notification choices in the Desktop App are kept only on that computer. Removing the Desktop App and its data removes these. Your projects, sites, and account stay in our Services as described in these Terms and our Privacy Policy.

Notifications and Microphone

The Desktop App asks before it shows notifications or uses your microphone, and uses them only for those features: telling you when a build finishes, a site goes live, or the AI needs your OK, and voice input in the chat. You can change either at any time in your computer's system settings.

Reliability Reports

The Desktop App may send us when it was opened, updated, or stopped unexpectedly, along with its version and your operating system, so we can keep it reliable. These reports follow your usage-sharing choice in WebTwizz settings. See our Privacy Policy for how we handle this data.

Third-Party Software

The Desktop App includes open-source software, such as Electron and Chromium, that is licensed to you under its own license terms. Those terms govern your use of that software.

Your Computer

The Desktop App is part of our Services, so the Disclaimers and Limitation of Liability sections below apply to it. We are not responsible for conflicts with other software or your computer's setup, or for the loss of anything kept only on your computer.

Acceptable Use

You agree not to use our Services to:

Illegal or Harmful Activities

  • Violate any applicable law, regulation, or third-party rights
  • Create, distribute, or promote illegal content
  • Engage in fraud, phishing, or deceptive practices
  • Harass, abuse, threaten, or harm others
  • Create content that exploits or harms minors
  • Generate malware, viruses, or malicious code

Platform Abuse

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt our Services or infrastructure
  • Circumvent rate limits, usage restrictions, or security measures
  • Use automated tools (bots, scrapers) without our written permission
  • Reverse engineer, decompile, or attempt to extract our source code
  • Resell, sublicense, or redistribute our Services without authorization

Content Restrictions

  • Create websites impersonating other individuals or organizations
  • Generate content that infringes copyrights, trademarks, or other IP rights
  • Produce spam, misleading content, or fake reviews
  • Create adult content, gambling sites, or other restricted content without appropriate measures

We reserve the right to investigate and take appropriate action against violations, including removing content, suspending accounts, and reporting to law enforcement.

Security Updates to Hosted Sites

We may apply security updates to the software packages of sites we host, to protect the site, its Users, or our Services. These updates are limited to package versions. They do not change your site's own code.

When we apply a security update, we tell you what changed and how to undo it.

You can turn automatic security updates off for each site. If an issue is being actively exploited, we may apply an update even when automatic updates are off, and we may take the site offline until it is fixed. See our Security page for how security updates work.

Intellectual Property

Our Intellectual Property

The Services, including our website, platform, software, AI models, templates, designs, logos, and documentation, are owned by WebTwizz and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our intellectual property without our written permission.

Trademarks

"WebTwizz" and our logos are trademarks of WebTwizz Technologies Inc. You may not use our trademarks without prior written consent, except as necessary to accurately describe your use of our Services.

Feedback

If you provide us with feedback, suggestions, or ideas about our Services, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that feedback without any obligation to you.

Copyright Complaints (DMCA)

If you believe content on our Services infringes your copyright, please send a notice to support@webtwizz.com including:

  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Your contact information
  • A statement of good faith belief that the use is unauthorized
  • A statement under penalty of perjury that your notice is accurate
  • Your physical or electronic signature

Payments & Billing

Pricing

Some features of our Services require payment. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice for existing subscribers.

Databases

Databases we host for your sites come with the data and monthly usage your plan includes. On the free plan, a database that uses all of its monthly usage pauses until the next month. On paid plans, usage beyond the included amount is charged in credits, and databases pause if your credits run out. When your databases are full, new data can't be saved until you free up space or upgrade.

Inactive Free Sites

On the free plan, a published site with no account activity for 6 months may be taken offline, and a database unused for 3 months may be archived. We email you first, and your project and data are kept, so you can publish the site again at any time.

Subscriptions

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription in your account settings.

Payment Processing

Payments are processed securely by Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for providing accurate billing information.

Refunds

Payments are generally non-refundable except as required by law or as explicitly stated in our refund policy. We may offer refunds at our discretion on a case-by-case basis.

Taxes

Prices may be exclusive of applicable taxes. You are responsible for paying any taxes associated with your use of the Services, except for taxes based on our income.

Termination

Termination by You

You may stop using our Services and delete your account at any time by contacting us at support@webtwizz.com. Deleting your account will remove your User Content and Generated Content from our active systems, though some information may be retained as required by law or for legitimate business purposes.

Termination by Us

We may suspend or terminate your access to the Services at any time, with or without cause, including if we reasonably believe you have violated these Terms. We will try to provide notice when possible, but we are not obligated to do so.

Effect of Termination

Upon termination:

  • Your right to use the Services immediately ceases
  • You remain liable for all charges incurred before termination
  • Provisions that by their nature should survive (such as limitation of liability, indemnification, and dispute resolution) will continue to apply

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Services will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties that defects will be corrected

AI-generated content may contain errors, inaccuracies, or inappropriate material. You use Generated Content at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill
  • Our total liability for any claims arising from or related to these Terms or the Services will not exceed the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD
  • We are not liable for any damages arising from your use of AI-generated content

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless WebTwizz and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your User Content or Generated Content
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your violation of applicable law

We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, and you agree to cooperate with our defense.

Disputes & Governing Law

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@webtwizz.com and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction

Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada. You consent to the personal jurisdiction of such courts.

Class Action Waiver

To the extent permitted by law, you agree to resolve any disputes on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Post the updated Terms on this page with a new "Last updated" date
  • Notify you by email or through a notice in the Services

Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
